Stuart Scuba LLC ("Stuart Scuba," "we," "us," or "our") uses customer information to answer questions and provide diving services. This policy explains how we collect, use, disclose, and protect personal information through our website, store, charters, training, travel, customer communications, and social media inquiry forms.

Information we collect

Depending on how you interact with us and the service you request, we may collect:

Contact and account details: Your name, email, phone number, address, account login information, and communication preferences.

Bookings and transactions: Purchases, payments, billing and delivery details, charter reservations, course registrations, rentals, and equipment service records.

Diving and safety information: Date of birth, certification and experience details, training records, waivers, emergency contacts, medical questionnaires, physician clearances, and requested accommodations.

Travel information: Traveler names, itineraries, and identification or passport details when needed to arrange your trip.

Communications and online activity: Information you submit through email, chat, calls, or Facebook and Instagram forms; website and device information described under Website tracking below.

We receive information from you, a parent or authorized booking organizer, and providers involved in your booking, payment, or certification. Provide another person’s information only when you are authorized to do so.

How we use information

We use information to respond to inquiries; manage accounts, orders, bookings, and payments; arrange training and certifications; verify participation requirements; coordinate travel; service equipment; communicate schedule changes and safety information; and maintain required business records. We also use relevant records to prevent fraud, resolve disputes, and comply with legal obligations. Marketing choices are explained below.

Medical and safety records

Medical questionnaires, physician clearances, and accommodation details are used for participation decisions, training administration, accommodations, and emergency response. Access and disclosure are limited to people who need the information for those purposes, or for necessary insurance, incident, or legal matters. We do not use these records for advertising or upload them to advertising platforms.

When information is disclosed

We may disclose relevant information to instructors and crew; certification agencies; booking, payment, website, messaging, and customer-support providers; shipping and equipment-service partners; and travel operators involved in your arrangements. These disclosures support the services described in this policy. We require providers acting on our behalf to protect information and limit its use to their work for us.

Information may also be disclosed to emergency responders, insurers, professional advisers, or authorities when necessary for emergencies, claims, legal obligations, or protecting lawful rights. A business sale or reorganization may involve a transfer of customer records, subject to applicable privacy obligations. Travel arrangements may require disclosure to providers outside the United States, where privacy laws differ.

We do not sell or rent customer contact lists. We do not give mobile numbers or text-message consent records to other companies for their own marketing. Providers may process this information to deliver our messages.

Payments

Payment information is used to complete transactions and address payment questions or disputes. Payment providers also process information under their own notices. Please do not send card numbers through social media messages or ordinary email.

Facebook leads, email, and text messages

When you submit a Facebook, Instagram, or website inquiry, we receive the information you provide and use it to respond about the service requested. Submitting an inquiry does not, by itself, enroll you in recurring promotional text messages. Social platforms also handle information under their own privacy policies.

Where permitted and consistent with your choices, we may send news and offers about our courses, charters, gear, events, and travel.

You can stop promotional emails using the unsubscribe link or by contacting us. We honor email opt-out requests within 10 business days. Essential booking, account, or safety communications may still be sent through an appropriate permitted channel.

If you separately opt in to promotional texts, message frequency varies and message and data rates may apply. Consent is not a

Retention and security

We retain information for the purposes described here, taking account of the service provided, required training and certification records, tax and accounting obligations, insurance requirements, and legal claims. Records subject to a legal preservation requirement may be kept longer. When information is no longer needed, we delete, de-identify, or securely dispose of it as appropriate.

We use reasonable administrative, technical, and physical safeguards and limit access to people who need information for their work. No system can guarantee complete security. We provide notices of security incidents when required by law.

Children’s information

Parents or legal guardians should handle registrations and personal-information submissions for children under 13. Information about younger divers is used for enrollment, instruction, certification, and safety. Where applicable law requires parental notice and verified consent before online collection, those steps must occur first. A parent may contact us about access, correction, or deletion of their child’s information.

Your choices and requests

Contact us to request access to, correction of, or deletion of your information, or to change marketing preferences. Depending on your location and applicable law, you may have additional rights, including obtaining a copy, withdrawing consent, limiting certain uses, or opting out of sale, sharing, or targeted advertising. We will address requests and any applicable appeals as required by law.

For record access or deletion, we may verify your identity or authority to act for someone else. Unsubscribing from marketing does not require identity documents. Some records may need to be retained for legal or other permitted reasons; we will explain relevant limits when responding.

We will update this policy and its effective date when our practices change. We will provide additional notice or obtain consent when required by law.
